1. Speed PRIVACY policy

The individual’s personal integrity and security of his or her personal data is important for all companies within the Speed Group (“Speed”) which are responsible for ensuring that all personal data is processed correctly and in accordance with applicable data protection legislation. The purpose of providing this privacy policy is to clarify why and in what way we process personal data. We therefore ask you to carefully read the Privacy Policy and contact us if you have any questions about its content.

2. SCOPE OF the PRIVACY POLICY

2.1 FOR WHOM THE POLICY APPLIES

This Privacy Policy applies to individuals who are candidates, employees, customers, suppliers and other stakeholders. Depending on your relationship with Speed, different chapters will be relevant to you.

2.2 EXTENT OF THE POLICY

This Privacy Policy regulates how Speed collects and processes personal data in order to provide our services in Logistics, Production, Staffing, Recruitment and Training, hereinafter referred to as “Services”. The policy also regulates the handling of personal data for individuals at the parties with whom Speed has a business relationship, such as suppliers and customers, as well as with potential, future customers.

3. PROCESSING OF PERSONAL DATA

Speeds’ handling of personal data is described below based on your relationship with Speed.

3.1 FOR YOU WHO ARE A CANDIDATE OR EMPLOYEE

3.1.1 PURPOSES OF PROCESSING PERSONAL DATA

Personal data is processed only for the purposes and purposes described in this Privacy Policy. Speed only processes personal data to the extent that such processing is necessary to be able to provide our services or other purposes listed below. This also applies to sensitive personal data. Speed processes applicants’ and employees’ personal data in order to be able to:

(a) provide our services to Speeds customers and offer you the opportunity to be a part of it
(b) administer our relationship with you, and in cases where you are employed, fulfill our obligations as an employer in accordance with the employment contract as well as laws and agreements in the labor market
(c) handle any cases of alleged discrimination, handle disputes and complaints against you or Speed from customers and suppliers
(d) conduct internal demographic studies and optimize Speeds’ operations

3.1.2 PERSONAL DATA

Below you will find information about what kind of personal data Speed processes and how Speed may receive / collect this information.

3.1.2.1 Candidate

The personal information Speed processes about you as a candidate is based on the information you provide to us via Speeds ‘web portal or through contact with Speeds’ recruiters or other internal staff. Avoid providing us with personal information that you do not agree to us processing and limit the disclosure of personal information to what is relevant to the recruitment process. Speed will not process your personal data without you first giving your approval when applying for a position.

The personal data we may process include name, address, e-mail address, social security number, grades, certificates, education and work experience, photography, results from tests, information from background checks, results from drug tests, information from reference person (such as reviews and health, e.g., remarks about sick leave) etc. In addition, information about usernames and login information for accounts is processed on our websites or systems. In the event that you agree to be photographed or that you leave a photograph of yourself without a request from Speed, you agree that Speed will process such a photograph.

In connection with the performance of tests, you may, at the request of us, need to approve additional conditions for the processing of your personal data.

Since some of Speeds’ customers place high security demands on individuals, we may in some cases need to perform background checks, credit checks, health checks and / or drug tests. Such checks may contain sensitive personal information about you, and you will be informed and, in some cases, must give a special consent before such a check is performed.

As part of a background check, Speed may ask you to submit an extract from the criminal records. You are the one who provide such an extract from the relevant authority. It is always you who decides if you want to order a criminal register extract. If you choose not to, it can affect your chances of becoming relevant for the position. The excerpt will be opened by you together with a representative from Speed. The information in a criminal register extract is handled with the utmost confidentiality and will never be saved or otherwise processed by Speed. However, Speed may orally reconcile the result with the customer in cases where there is doubt about your suitability for the position.

Speed may also ask you to provide additional personal information. You will then be further informed and need specifically to approve this. Personal data provided / processed through special approval will also be covered by this Privacy Policy.

3.1.2.2 Employees

The personal information we will process about you consists of, in addition to the information specified in section 3.1.2.1 (Candidate), contact information for relatives, salary and bank account information, citizenship and / or information on status regarding work permits. As an employer, we will also process information that emerges in connection with personal development meetings and salary negotiations.

3.1.3 STORAGE OF PERSONAL DATA

How long a personal data is stored depends on the personal data in question and the purpose of its processing. The information you register in your profile or that we at Speed register in our business system will be stored as long as your account is active, during the ongoing contractual relationship and thereafter, in some cases, for a period stated by law. Your account is considered inactive if you have not logged in for such a long period that gives Speed reason to believe that your personal information has become obsolete, you do not have an employment relationship with Speed or you have revoked your consent to Speed’s processing of your personal information.

As a rule, Speed will save personal data relating to:

(a) information related to the application and recruitment process, during the current year for the most recent activity and thereafter for three (3) years in cases where no employment agreement has been reached
(b) employment contract, during the period of employment and thereafter two (2) years
(c) customer and supplier agreements as well as information on business events, such as information on time reports, participants, assignments, salary, invoice, declarations, financial statements, during the contract period and thereafter for ten (10) years
(d) control information, until Speeds’ pension commitments expire

3.2 FOR YOU WHO ARE A CUSTOMER, POTENTIAL CUSTOMER OR SUPPLIER

3.2.1 PURPOSES OF PROCESSING PERSONAL DATA

Personal data is processed only for the purposes and purposes described in this Privacy Policy. If you choose not to provide us with certain personal information, it may affect the use of the Service or the provision of the Service.

Speed only processes personal data to the extent that such processing is necessary for the Service and for services that suppliers provide to Speed or for such other purposes as set out below. This also applies to sensitive personal data.

Speed processes personal data about customers’, potential customers’ and suppliers’ employees in order to:

(a) you must be able to access the Service or provide other services to Speed;
(b) administer our relationship with you;
(c) Speed must be able to handle its obligations to you or the individual concerned, handle cases of alleged discrimination, handle disputes and complaints; and
(d) enable future business relationships.

3.2.2 PERSONAL DATA

Speed may also request that the individual provide additional personal information than specified below. Personal data provided / processed through special approval will also be covered by this Privacy Policy.

3.2.2.1 Customers and potential customers

Speed may process contact persons’ personal data. Such information includes name, address, e-mail address, position, areas of responsibility and other information that is necessary for the provision and follow-up of the Service and to enable future business relationships. If you are a customer of ours as a training participant, we also process information about your training result.

3.2.2.2 Suppliers

Speed may process the personal data of contact persons and other employees. Such personal data consists, inter alia, of the data specified in section 3.2.2.1 (Customers). In some cases, they may consist of tasks in accordance with 3.1.2.1 (Candidate), usually when you provide sub-consulting services. Only the information that is necessary for the provision and follow-up of the Service, to ensure a good delivery of services to Speed and to enable future business relationships are processed.

3.2.3 STORAGE OF PERSONAL DATA

How long personal data will be stored depends on the personal data in question and the purpose of its processing. Speed does not store personal data for a longer period than is necessary regarding to the purposes for which it was collected, unless otherwise provided by law.

The information that you as a supplier register in your profile(s), or that Speed registers in Speeds’ business system, will be stored as long as each account is active or during an ongoing contractual relationship. An account is considered inactive if no one has logged in for such a long period that gives Speed reason to believe that the personal information has become obsolete, or we are notified that this is the case.

As a general rule, Speed will save personal data that occurs in:

(a) application and recruitment processes, during the current year for the most recent activity and thereafter for three (3) years;
(b) customer and supplier agreements as well as information on business events, such as information on time reports, participants, assignments, salary, invoice, declarations, financial statements, during the contract period and thereafter for ten (10) years.

3.3 PERSONAL DATA FOR MARKETING PURPOSES

The information that Speed collects and processes can, by the Speed company in question and other companies within Speed Group, be used for marketing and market research in order to provide candidates, employees, customers, potential customers and suppliers with a better experience and improve and optimize quality of the Service (for example, by displaying content that may be of interest to you and delivering more relevant information to you).

In case you no longer wish to receive marketing, you can contact us and indicate that you do not wish to be contacted for marketing purposes.

3.4 USE OF SPEEDS WEBSITE AND COOKIES

We also use third-party analytics services on our websites, such as Google Analytics. The analytics providers that handle these services use technologies such as cookies, web server logs and web beacons to help us analyze how you use our websites. The information collected through these methods (including IP address) may be disclosed to these analytics providers and other relevant third parties who use this information to evaluate, for example, the use of the websites. 4. PROTECTION OF PERSONAL DATA

Speed has taken appropriate technical and organizational measures to protect personal data against loss, misuse, unauthorized access, disclosure, alteration and destruction. To ensure that personal data is processed in a secure and confidential manner, we use data networks that are protected against intrusion, including firewalls, access restrictions and password protection. To ensure the privacy of the personal information you provide via the Internet, we may use encryption technology when we transfer such personal information over the Internet to our servers. Speeds’ employees and suppliers are bound by confidentiality agreements and are obliged to comply with Speeds’ rules for information and IT security, this Privacy Policy and other internal regulations that further regulate the processing of personal data.

5. SHARING OF PERSONAL DATA BETWEEN COMPANIES WITHIN THE SPEED GROUP

As a rule, Speed shares personal data originating from the candidate, employee, customer and supplier’s employees with all companies within Speed Group in order to be able to provide the Services. Sharing is necessary to offer candidates and employees relevant and exciting assignments quickly and efficient, and in addition offer the best skills for Speed’s customers and engage in new business relationships. Sharing of personal data does not apply to participants of Speed Education’s trainings.

As a rule, sensitive personal data is not shared between the companies within Speed Group, except for when payroll management is performed by another Speed company. Before sharing sensitive personal data, Speed always assesses whether such a sharing is necessary for the purpose for which the sensitive personal data was collected and whether further consent to the sharing is needed or whether there is legal support for sharing the personal data.

A prerequisite for the sharing of personal data between companies within Speed Group is that it is carried out in accordance with this Privacy Policy and relevant personal data legislation.

6. SHARING OF PERSONAL DATA OUTSIDE COMPANIES IN SPEED GROUP

Speed will not sell, disclose or distribute personal information to third parties, except as provided in this Privacy Policy. Within the framework of the Service, personal data may be passed on to one of Speeds’ customers, suppliers, subcontractors, and partners if this is necessary for the performance and provision of the Service. Speed may also disclose your personal information to other third parties, such as Speeds’ suppliers for our business, for example for payroll administration, technical support, operation of IT systems, external test companies or suppliers who handle job searches on our behalf. Parties to which Speed may disclose personal data may, in exceptional cases, be outside the European Economic Area, EEA, which means that personal data may be transferred to countries outside the EEA. If Speed discloses personal data to suppliers outside the EEA, we will take measures to ensure that the personal data remains protected and also take the necessary measures to legally transfer personal data to countries outside the EEA.

Furthermore, we may disclose personal data if we are obliged to do so in accordance with applicable law, authority or court decision or if such disclosure is otherwise necessary to participate in a legal investigation. In the event that Speed is subject to a reorganization, merger or sale, we may transfer personal data to the relevant third party, provided that the third party undertakes to process the personal data in accordance with this Privacy Policy.

Each company listed above, is responsible for the processing of the personal data and to make sure the processing takes place in accordance with applicable law.

8. SPEED AS A PERSONAL DATA assistant

As a rule, Speed is responsible for personal data, but there may be situations where Speed is instead a personal data assistant. When Speed processes personal data in its capacity as a personal data assistant, this is done on behalf of a third party and Speed is then bound by the instructions provided by the personal data controller. In these situations, Speed will ensure that processing takes place in accordance with applicable law and, as far as possible, in accordance with this Privacy Policy.

9. Your rights

According to the Data Protection Regulations, you have the right to be informed of which personal data that Speed processes about you and information about the scope and purpose of such processing. You also have the right to request that we correct any incorrect personal information or completely delete the personal information we have registered about you. You always have the right to revoke a given consent and announce that you oppose further processing of your personal data. If you have made such a request, our processing of your personal data will continue in the parts we are obliged by law, regulation or authority to process them. 10. UPDATES OF THIS PRIVACY POLICY

Speed reserves the right to revise this Privacy Policy whenever needed. The date of the last change is stated at the end of the Privacy Policy. If we make any updates of the Privacy Policy, we will publish these changes on our website. You are therefore advised to read this Privacy Policy regularly to be aware of any changes. If our processing of your personal data is based on consent and we change this Privacy Policy in a significant way, we will notify you of these changes and in cases where it is necessary, we will request a new consent for continued protection.
